INTELLECTUAL PROPERTY LITIGATION EXPERIENCE 

Terry Welch is a member of the firm's litigation group with substantial trial, arbitration and mediation experience in federal and state courts for high-tech and innovative companies as well as Japanese and other international entities. Mr. Welch has handled trials ranging from half-day, 4-person jury trials in state court to multi-week complex federal trials.  He has handled dozens of mediations and arbitrations of all shapes and sizes relating to patents, trademarks, intellectual property, products liability, commercial insurance claims in excess of $100 million dollars, and other issues.

Clients contact Mr. Welch on broad-ranging issues including, most particularly, intellectual property disputes, patent litigation, products liability, manufacturer-distributor relations, and antitrust. Representative clients include Action Target, an innovative manufacturer and worldwide distributor of reactive target systems, Geneva Steel Company, Merit Medical, Non-Invasive Medical Technologies, Dentrix Dental Systems, Henry Schein, Ortho Development, an international company with significant Japanese and Pacific-Rim involvement, HemaMetrics, a medical device company with Pacific Rim involvement, Gastec-a Japanese based manufacturer and patent-holder of high-tech gas detection tube devices, Centrex, Inc., Novell, Pioneer Equipment, Cate Equipment, Zevex and Wal-Mart.

Mr. Welch has developed a reputation as a skilled IP and patent litigator with expertise to rival those at national firms at a lesser cost.  He has taken over several cases from National or Silicon Valley firms after having been hired originally as local or co-counsel.  Results include reversal in the Federal Circuit Court of Appeals of an unfavorable Markam ruling; overturning of an injunction against an accused infringer that the adverse party had obtained prior to Mr. Welch's involvement; findings of infringement in favor of his clients; victories on summary judgment; and the obtaining of injuctive relief. 

Mr. Welch served on the Executive Committee of the Young Lawyers Division of the Utah State Bar in 1993-1994 and is currently a member of the Intellectual Property division. He served as a member of the Board of Directors of the Family Support Center, a local charitable organization helping abused and under-privileged children and women, from 1999-2004.  

Mr. Welch is frequently cited by legal peers as one of the top commercial litigators in Utah: Utah Business magazine's Legal Elite 2005-2012 (and every year since the inaugural issue, including recognition as a Top 100 lawyer), The Best Lawyers in America (2004 through 2012), The Best Lawyers in America, Corporate Counsel edition (2009), Mountain Super Lawyers (2005 through 2011), Super Lawyers, Corporate Counsel edition (2009), including Top 75 lawyers in five state area, 2011.
